Sylvester Terms and Conditions

The Sylvester platform and software service (“Sylvester”) is owned and operated by Sylvester.AI, Inc. (“Sylvester”). By accessing or using Sylvester, you acknowledge your agreement to these Terms of Service (the “Terms”) which form a binding agreement between you and Sylvester. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE SYLVESTER.

  1. License Condition. Sylvester provides Sylvester solely on the terms and conditions set forth in these Terms and on the condition that you comply with these Terms.

  2. Age. You hereby represent and warrant that you are 18 years of age or older.

  3. Collection & Use of Information. You hereby acknowledge that Sylvester may directly or indirectly collect and store information about and from users of Sylvester. All collection and use of personal information shall be governed by Sylvester’s Privacy Policy available at [LINK] (the “Privacy Policy”). You hereby agree to Sylvester’s collection, storage and use of your personal information in accordance with the Privacy Policy.

  4. Suspension of Access: Sylvester may suspend or terminate your access to Sylvester at any point if you violate these Terms or if Sylvester, at its sole discretion, deems it reasonably necessary to do so for any purpose.

  5. Disclaimer: YOU HEREBY ACKNOWLEDGE THAT ANY ASSESSMENTS MADE OR RESULTS PROVIDED (“ASSESSMENTS”) ON Sylvester ARE PROVIDED “AS-IS” WITHOUT ANY GUARANTEE OF ACCURACY OR RELIABILITY. ASSESSMENTS ARE NOT INTENDED TO BE AND SHOULD NOT BE USED AS SUSBTITUES FOR PROFESSIONAL VETERINARY ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR VETERINARIAN WITH ANY QUESTIONS YOU MAY HAVE REGARDING THE MEDICAL CONDITION OF YOUR PET. IF YOU THINK YOUR CAT HAS A MEDICAL EMERGENCY, CALL OR VISIT YOUR VETERINARIAN IMMEDIATELY.

  6. Use of Images. As set out in more detail in the Privacy Policy, the images you upload to Sylvester (“Images”) will be shared with your specified veterinary provider and will be used by Sylvester to improve its products and services. IF YOU DO NOT WANT AN IMAGE TO BE SHARED WITH YOUR VETERINARY PROVIDER, DO NOT UPLOAD THE IMAGE TO Sylvester.

  7. Waiver of Claims. YOU HEREBY EXPRESSLY WAIVE AND RELEASE SYLVESTER FROM ANY AND ALL CALIMS THAT YOU MAY HAVE IN THE FUTURE AGAINST SYLVESTER, ITS AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES, SHAREHOLDERS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, "RELEASEES"), ARISING OUT OF OR ATTRIBUTABLE TO YOUR USE OF Sylvester, INCLUDING WITHOUT LIMITATION WITH RESPECT TO THE CONTENT AND ACCURACY OF ASSESSMENTS. YOU COVENANT NOT TO MAKE OR BRING ANY CLAIM AGAINST SYLVESTER OR ANY OTHER RELEASEE RELATED TO THE FOREGOING AND FOREVER RELEASE AND DISCHARGE SYLVESTER AND ALL OTHER RELEASEES FROM LIABILITY UNDER SUCH CLAIMS.

  8. Limitation of Liability. IN NO EVENT WILL: (I) SYLVESTER OR ANY OF THE RELEASEES BE LIABLE IN CONNECTION WITH THESE TERMS AND/OR YOUR USE OF Sylvester FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, AGGRAVATED, PUNITIVE, OR EXEMPLARY DAMAGES; OR (II) THE COLLECTIVE AGGREGATE LIABILITY OF SYLVESTER AND THE RELEASEES RESULTING FROM THESE TERMS AND YOUR USE OF Sylvester EXCEED THE AMOUNT PAID BY YOU TO Sylvester FOR ACCESS TO Sylvester IN THE TWELVE (12) MONTHS PRECEDING THE EVENTS GIVING RISE TO THE APPLICABLE CLAIM.
